A Justice Watchdog says a Judge who reduced a sentence for a recidivist criminal could have only done to so to ensure the longevity of the Criminal Justice Industry.

High Court Justice David Collins said another Judge overreacted when sentencing a recidivist criminal who had amassed 77 previous convictions including the killing of a young woman.

But the Sensible Sentencing Trust has accused Justice Collins of aiding and abetting the criminal fraternity and ensuring the longevity of a thriving Criminal Justice Industry.

SST Founder Garth McVicar said he was ‘absolutely livid’ at what he termed the crass stupidity of Justice Collins.

“Justice Collins has in one foul-swoop made a mockery of the Judiciary, played into the hands of all law breakers and ensured the Criminal Justice Industry flourishes.”

“Jordan Young has flouted the law and milked an already offender friendly system and Justice Collins has just given Young a big thumbs-up and ensured his life-long involvement with the Criminal Justice Industry.”

McVicar said he was struggling to decide who was the most stupid, Young or Collins.

“Young is a criminal, a repeat offender; we expect on-going criminal behaviour from him, that’s what he does for a living, albeit sanctioned by the inappropriately named Justice System.”

“But Justice Collins is supposedly a well-educated pillar of the community, a man of some standing in society. Being a High Court Judge must automatically mean he carries a degree of responsibility for the safety and protection of the community he serves. Sadly Justice Collins has let the community down.”

McVicar said the SST has made submissions to Parliament calling for an annual review of the Judiciary, “similar to what the medical profession has.”

“While the public are rightly concerned about New Zealand’s appalling crime rate they need to realise the Judiciary by failing to give out deterrent sentences [or reducing them when one brave Judge does so] are largely responsible. The Judiciary are dishing out sentences of about 1/4 of the maximum allowed for a particular offence and are refusing to utilise the tools Parliament has given them – such as three strikes for repeat offenders.”

“Parliament is meant to be the Highest Court in the land but many Judges [such as Justice Collins] are ignoring legislation passed by Parliament.”
“At present the Judiciary are simply feathering their own nest.”

“Until Parliament introduces a system to audit and review the Judiciary New Zealand’s crime rate and the prison population will continue to grow.”
